Mediation has, of late, been recognized as one of the fastest-growing modes of alternative dispute resolution, allowing parties to relook at mutual interests and come up with innovative solutions through an interactive and facilitative process. Mediation is voluntary and non-binding upon the parties and issues are resolved through negotiation using proper communication techniques. On July 31, 2019, the Union Cabinet, chaired by Prime Minister Narendra Modi, approved the signing of the United Nations Convention on International Settlement Agreements Resulting from Mediation (popularly referred to as the “Singapore Convention”) by the Republic of India. This led to the signing of the Singapore Convention by India on August 07, 2019, and puts the future of mediation and mediated settlements in India on a strong pedestal.
