India became a liberalized and globalized economy in 1991 embracing the free market vision of its western counterparts. This was followed by the need for setting grounds for regulation as a check against the tendencies of players to distort free market competition by indulging in anti-competitive practices.
The Competition Act, 2002 (“Competition Act”) sets the contours of market intervention by the Competition Commission of India (CCI) in India. Similar to EU competition law, the Competition Act has a three pronged regulatory regime: merger review, anti-competitive agreements and abuse of dominance.
Against this background, we launch our updated paper providing an overview on “Competition Law in India”. Our paper will provide a big picture review of the development of competition law in India. The paper also provides a preview on CCI/appellate court analysis and processes in merger review and investigations. Based on review of CCI’s jurisprudence, we conclude by suggesting few general risk mitigation strategies that companies may use as pointers.
